Complete Rules for Supporting Extracurricular Activities of Students of Charles Univ December 2016 ****************************************************************************************** Under sections 9 (1) (b) and 17 (1) (i) of Act No. 111/1998 Sb., to regulate higher educat and to change and amend other laws (“the Higher Education Act”), as amended, and under Art of the Constitution of Charles University, the Academic Senate of Charles University has a following Rules for Supporting Extracurricular Activities of Students of Charles Universit regulation. ****************************************************************************************** * Article 1 Introductory Provisions ****************************************************************************************** These Rules for Supporting Extracurricular Activities of Students of Charles University (“ regulate the basic conditions and main forms of support as well as the procedure for grant extracurricular activities of students of Charles University (“the University”). ****************************************************************************************** * Article 2 Fundamental Provisions ****************************************************************************************** 1.For the purposes of these Rules, “extracurricular activity” means any activity aimed, in with Article 5 of the Constitution of the University, at the fulfilment of sporting, cul and other needs of students in their leisure time, at the organization of debates, talks meetings, and at the provision of information services, the organization of exhibitions, stipulated otherwise in these Rules. 2.For the purposes of these Rules, the following are not considered extracurricular activi a.any activity aimed at supporting political parties or movements, trade unions, organis employers or professional organisations, churches, or religious societies; b.any profit-making activity, unless it is stipulated that all profits will be used in f pursuit or support of an extracurricular activity; c.any activity carried out directly by the University or a faculty or other unit of the d.any activity directly leading to the performance of study duties or duties arising out employment or contractual relationship, unless it is a relationship with the Universit in connection with these Rules, or to the performance of other obligations; or e.any activity directly related to or following the activities of academic bodies of the faculties. 3.Support under these Rules may be provided: a.to associations (hereinafter the "Student Association"), b.to foundation and endowment funds; provided that the said legal entities are established for the purpose of pursuing or sup extracurricular activities, or that the pursuit or support of extracurricular activities accordance with their articles of association, the charter, the constituting instrument, an independent activity, separable from other activities both organisationally and econo 4.Support under these Rules may be provided for: a.extracurricular activities at the University; b.extracurricular activities at a faculty. 5.Support of extracurricular activities at the University under Article 3 and 4 may only b a student association, foundation, or endowment fund that engages or intends to engage i relating to the student part of the academic community of at least two different faculti University. The support of extracurricular activities at a faculty under Article 3 and 4 provided to a student association, foundation, or endowment fund that engages or intends an extracurricular activity related to the student part of the academic community of tha students are either members of the student association or members of the governing or su of the foundation or endowment fund pursuant to paragraph 7. 6.Support of extracurricular activities at the University under Article 3 and 4 may be pro the condition that; a.a student association has at least 20 members – individuals, of which at least 50% are students, and, at the same time, are not students of only one faculty of the Universit the student association are also legal entities, at least 50% of these legal entities student associations according to paragraph 7 (a); b.at least 50% of members of governing and supervisory bodies of a foundation or endowme from among the University students who, at the same time, are not students of only one University. 7.Support of extracurricular activities at a faculty under Article 3 and 4 may be provided condition that: a.a student association has at least 10 members – individuals, of which at least 50% are faculty; b.at least 50% of members of the governing and supervisory bodies of a foundation or end from among University students. ****************************************************************************************** * Article 3 Forms of Support ****************************************************************************************** 1.A student association, foundation, or endowment fund may be provided support, in accorda University regulations, in the following forms: a.one-off or periodic financial support from the earmarked funds for economic activity w of the University, b.simple loans for consumption , c.preferential lease or rental of immovable property, d.preferential lease or rental of movable property, e.a gift. 2.Regular support under paragraph 1 (a) can only be provided for extracurricular activitie University. 3.In addition, support to a student association, foundation, or endowment fund may be prov providing space on the University Websites if it is to promote the purpose pursued by th agreement on the provision of support. 4.A student association, foundation, or endowment fund may be permitted, under the associa concluded with the University, to use the University's emblem (Article 56 of the Univers and Article 3 (2) of the Principles of the Use and Protection of the University Coat of 5.The type and amount of support is to be determined in particular on the basis of: a.the type of the extracurricular activity performed or the extracurricular activity whi intends to perform, the degree of its benefit to students, and the financial and other of the activity; b.facts set out in the application for support; c.the applicant's previous activities. 6.The principles for the granting of individual types of support and the extent thereof, a limits for the individual forms of support, are set out in a Rector's directive, on whic Senate of the University (“the Senate”) expresses its opinion. 7.The Rector's directive under paragraph 6 may also provide that, subject to meeting certa there is a legal right to the support under Article 3 (1) (a). 8.Other than situations under paragraph 7, there is no legal right to the provision of sup ****************************************************************************************** * Article 4 Granting of Support ****************************************************************************************** 1.An application for the granting of support is submitted to the Rector. The formal elemen application, deadlines for submission, and other details are set out in the Rector's dir compliance with Article 3 (6). 2.A student association, foundation, or endowment fund applying for the granting of suppor registered in a list maintained by the University; details regarding this list and regis out in the Rector's directives in compliance with Article 3 (6). 3.The Social Commission of the Academic Senate expresses its opinion on the application fo of support for extracurricular activity at the University. 4.Applications for the provision of support for extracurricular activities at a faculty su to a given deadline are assessed by the Evaluation Commission. The Evaluation Commission members, each of whom must be a member of the academic community of another faculty. The Evaluation Commission are appointed and dismissed by the Rector upon a proposal from the term of office of the members of the Board is two years. 5.A decision on the provision of support is made by the Rector, or, where an internal regu University prescribes so, by the Senate upon a proposal from the Rector. 6.The Rector will decide on whether the support will be provided, or will submit a relevan the Senate, within 10 days of the delivery of the opinion of the Social Commission of th Senate or the Evaluation Commission. 7.An agreement on the provision of support must always include provisions on how to prove has been used in accordance with the set purpose, as well as provisions on the procedure in cases of failure to comply with the conditions under which the support was provided o conditions have only partially been complied with; details are set out in the Rector's d under Article 3 (6). 8.Compliance with the conditions under which the support was provided is assessed by a fiv commission. The members of this commission are appointed and dismissed by the Rector; tw appointed upon nomination by the Senate. Membership in this commission is incompatible w in the Social Commission of the Academic Senate, as well as with membership in the Evalu under paragraph 4. The term of office of commission members is two years. ****************************************************************************************** * Article 5 Final Provisions ****************************************************************************************** 1.These Rules were approved by the Academic Senate of the University on 26 January 2007. 2.These Rules come into force on the date of the registration by the Ministry of Education Sports. 3.These Rules become effective five days after they have come into force.
