1. UK prostřednictvím CUIP spoluvlastní společnost GeneSpector. Její patent však napadla FTN s tím, že stojí na datech, které nebyly určené pro komercionalizaci. Jak se k tomu staví UK?

Registrujeme, že proběhla komunikace mezi zástupci 1. LF UK a FTN, nicméně Univerzita Karlova ani CUIP neregistruje žádný oficiální spor, rozpor či právní výzvu ze strany Fakultní Thomayerovy nemocnice ve vztahu k patentu společnosti GeneSpector.

2. Je možné, že došlo ke zneužití dat bez vědomí FTN?

Univerzita Karlova nemá žádné informace ani podklady, které by nasvědčovaly zneužití dat či jinému pochybení. Žádný z dostupných dokumentů nevypovídá o tom, že by došlo k neoprávněnému nakládání s daty Fakultní Thomayerovy nemocnice. Dostupné dokumenty a informace naopak svědčí o tom, že s daty bylo nakládáno v souladu s pravidly a v rámci oprávněných postupů.

3. Jak se díváte na možný střet zájmů, kdy patentová přihláška byla podaná v roce 2021 prostřednictvím patentové kanceláře Machů IP, přičemž pan Matěj Machů byl v té době zástupcem ředitele CUIP?

Výběr patentového zástupce byl plně v kompetenci společnosti GeneSpector jakožto samostatné právnické osoby. Volba patentové kanceláře tak nesouvisela s pozicí zástupce ředitele v CUIP.

4. Jaké finanční prostředky získala UK (skrze CUIP) z komercionalizace produktů GeneSpector v období let 2021–2024?

Výnosy plynoucí Univerzitě Karlově prostřednictvím CUIP z komercionalizace produktů společnosti GeneSpector v období let 2021–2024 dosáhly 16,9 milionů korun.

5. Jak se díváte na možný střet zájmů pana Michala Pohludky, který byl místopředsedou správní rady CUIP a zároveň spoluvlastní přes firmu mikeVision společnost GeneSpector?

Univerzita Karlova v dané věci střet zájmů neshledává. Dr. Michal Pohludka působil od listopadu 2021 jako člen a od dubna 2022 do října 2024 jako místopředseda správní rady, která je kolektivním orgánem, a jako takový neměl možnost samostatně rozhodovat. Činnost správní rady podléhá dohledu sedmičlenné dozorčí komise CUIP, která nikdy nereportovala žádné pochybení ani střet zájmů. CUIP rovněž každoročně podává přehledy o ovládajících osobách, které jsou součástí pravidelného auditu. Ten žádné nedostatky v této oblasti také nikdy nekonstatoval.

1. Through CUIP, Charles University co-owns GeneSpector. However, FTN has challenged its patent, arguing that it is based on data that was not intended for commercialization. What is Charles University's position on this?

We are aware that there has been communication between representatives of the First Faculty of Medicine of Charles University and FTN, but neither Charles University nor CUIP has registered any official dispute, disagreement, or legal challenge from Thomayer Hospital in relation to GeneSpector's patent.

2. Is it possible that the data was misused without FTN's knowledge?

Charles University has no information or evidence to suggest that data has been misused or that any other misconduct has occurred. None of the available documents indicate that the data of the Thomayer University Hospital has been handled in an unauthorized manner. On the contrary, the available documents and information indicate that the data was handled in accordance with the rules and within the scope of authorized procedures.

3. How do you view the possible conflict of interest, given that the patent application was filed in 2021 through the patent office Machů IP, while Mr. Matěj Machů was the deputy director of CUIP at the time?

The selection of the patent attorney was entirely within the competence of GeneSpector as an independent legal entity. The choice of patent office was therefore not related to the position of deputy director at CUIP.

4. What financial resources did Charles University (through CUIP) receive from the commercialization of GeneSpector products in the period 2021–2024?

The revenues received by Charles University through CUIP from the commercialization of GeneSpector products in the period 2021–2024 amounted to CZK 16.9 million.

5. How do you view the potential conflict of interest of Mr. Michal Pohludka, who was Vice-Chairman of the CUIP Board of Directors and also co-owns GeneSpector through mikeVision?

Charles University does not see any conflict of interest in this matter. Dr. Michal Pohludka served as a member of the board of directors, which is a collective body, from November 2021 and as vice-chairman from April 2022 to October 2024, and as such he did not have the power to make independent decisions. The activities of the administrative board are supervised by a seven-member CUIP supervisory committee, which has never reported any misconduct or conflict of interest. The CUIP also submits annual reports on controlling entities, which are part of a regular audit. The audit has never found any shortcomings in this area.
